To be covered under the Longshore Act, the injured worker
must meet situs (where the injury occurred) and status (the type
of work being done when injured) and must be involved in maritime
work, which is ship building, ship repair, ship breaking, or the
loading or unloading of vessels.
An employee qualifies to be covered under the Jones Act if
they are permanently assigned to a vessel or a fleet of vessels
and is furthering the mission of that vessel, such as the Captain
of a Vessel, deck hands or crew members.
